Terms of Service
Effective date: February 20, 2026
1. Service Description
Quell ("the Service") is an AI-powered communication formatting tool that rewrites incoming text messages in calm, neutral language before delivery. Quell is not a licensed mediation service, legal counsel, therapy, or emergency service. The Service is available only in the United States and is intended for users who are at least 18 years of age.
2. How It Works
When you send or receive a text message through your Quell channel, the message is processed by artificial intelligence, rewritten in neutral language, and forwarded to the other participant. All outbound messages are prefixed with "Quell:" to clearly indicate they have been reformatted by AI.
Quell does not store message content at any point during this process. Each message is processed in real time and immediately discarded by Quell. There is no message history, no chat archive, and no way for anyone — including Quell staff — to retrieve past messages. Note that telecommunications carriers and other third-party services involved in message delivery may retain data according to their own policies, which are outside Quell's control.
3. Acceptable Use
You agree not to use Quell to:
- Send threatening, harassing, or illegal content
- Attempt to circumvent the AI rewriting system
- Impersonate another person or misrepresent your identity
- Use the service for any purpose other than personal communication
- Use the service for emergencies or time-critical safety situations
- Attempt to use the service without the other participant's knowledge or consent
4. Consent and Participation
Quell requires explicit consent from both participants before processing messages between them:
- Subscriber (Party A) — consents to these Terms and our Privacy Policy at checkout.
- Invited participant (Party B) — is informed thatQuell is an AI service that rewrites messages, and consents by replying JOIN. By replying JOIN, Party B agrees to these Terms of Service and the Privacy Policy at textquell.com/terms and textquell.com/privacy.
Either party may revoke consent at any time by replying STOP. Consent events (timestamp, phone number, and method) are logged for compliance purposes. No message content is included in these records.
4A. SMS Messaging Terms
By opting in to Quell via the web form at textquell.com or by replying JOIN to an invitation message, you consent to receive recurring automated text messages from Quell at the phone number you provide. These messages include proxy-delivered communications from the other participant (rewritten by AI), service notifications, and transactional messages related to your subscription.
- Message frequency: Message frequency varies based on how actively you and the other participant use the channel. There is no fixed number of messages per month.
- Message and data rates: Standard message and data rates from your wireless carrier may apply. Quell does not charge per-message fees beyond the $10/month subscription.
- Opt-in: The subscribing party (Party A) opts in by providing their phone number and completing checkout at textquell.com, which constitutes consent to these Terms and our Privacy Policy. The invited party (Party B) opts in by replying JOIN to the invitation SMS, which constitutes consent to these Terms and our Privacy Policy. Consent to receive messages is not a condition of any purchase for Party B.
- Opt-out: You may opt out at any time by replying STOP to any message from your Quell number. You will receive a single confirmation message, and no further messages will be sent. Opting out terminates your participation in the channel.
- Help: Reply HELP to any Quell message for support information, or email hello@textquell.com.
- Supported carriers: Quell supports all major US wireless carriers including AT&T, T-Mobile, and Verizon. Carrier support is subject to change.
- Representation regarding invited party: By inviting another person to communicate through Quell, you represent that you have a pre-existing personal relationship with that person (such as a co-parent, family member, former partner, or similar) and that the invitation is not being sent for the purpose of harassment, spam, or unwanted commercial contact. Quell reserves the right to suspend or terminate your account if this representation is found to be false.
5. AI Disclosure and Limitations
All messages processed through Quell are rewritten by artificial intelligence. You should be aware of the following:
- The AI rewriting system is not perfect and may occasionally alter the meaning, drop nuance, or miss context in messages.
- Quell is not liable for any consequences arising from altered meaning in rewritten messages.
- Messages containing only insults or emotional content with no logistical information may be summarized rather than rewritten verbatim.
- High-risk content (threats, legal language, medical emergencies) may be forwarded unfiltered so you have a record.
6. High-Risk Content
Messages that contain content with serious real-world consequences — threats, legal language, medical emergencies, and similar sensitive content — are not rewritten. So you have a record, Quell may forward high-risk content unfiltered.
7. Payment
Quell costs $10 per month, billed through Stripe. Your subscription renews automatically each month until you cancel. By subscribing, you authorize Quell to charge your payment method on a recurring monthly basis.
If the invited participant does not join your channel within 30 days of your subscription start date, you may request a full refund by sending the command REFUND to your provided Quell number over SMS.
8. Cancellation
You may cancel your subscription at any time through Stripe. Your service will remain active until the end of the current billing period. Upon cancellation, Quell permanently deletes all routing metadata associated with your channel.
9. Privacy
Your privacy is central to Quell. Please review our Privacy Policy for details on what data we collect and how it is handled.
10. Termination
We may suspend or terminate your access if you violate these Terms, if your subscription lapses, or if we determine that your use of the service poses a risk to other users or to the operation of the service. Upon termination, Quell deletes all routing metadata.
11. Disclaimers
Quell is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Quell is not a substitute for professional legal counsel, licensed mediation, therapy, or any other professional service. Quell is not an emergency service. If you or someone else is in immediate danger, call 911.
It is usually cheaper and easier to address communication problems early. Early communication support can be a lower-friction option before conflicts escalate. However, Quell does not guarantee any particular outcome.
12. Limitation of Liability
To the fullest extent permitted by law, Quell and its operators, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses.
In no event shall Quell's total liability to you exceed the greater of (a) $50 or (b) the total amount you paid to Quell in the twelve (12) months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Quell and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the service, your violation of these Terms, or your violation of any rights of another party.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language.
You agree to waive any right to participate in a class action or class-wide arbitration. Claims may only be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
Notwithstanding the above, either party may bring a claim in small claims court if the claim qualifies for small claims jurisdiction.
15. Modifications
We may update these Terms from time to time. If we make material changes, we will notify you at least 30 days in advance via SMS to your registered phone number or by email if available. Your continued use of the service after the effective date of the revised Terms constitutes your acceptance of the changes.
16. Age Requirement
You must be at least 18 years of age to use Quell. By subscribing to or using the service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
17. Geographic Scope
Quell is currently available only in the United States. Both participants must have US phone numbers (+1 country code). The service is not intended for use in any jurisdiction where it would be prohibited or restricted by law.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
19. Assignment
You may not assign or transfer these Terms or your rights under them without Quell's prior written consent. Quell may assign these Terms without restriction in connection with a merger, acquisition, or sale of assets.
20. Force Majeure
Quell shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, telecommunications failures, or power outages.
21. Intellectual Property
Quell and its operators retain all rights, title, and interest in and to the service, including all associated intellectual property rights. Your use of Quell grants you a limited, non-exclusive, non-transferable, revocable license to use the service in accordance with these Terms.
22. Notice
Quell may provide notices to you via SMS to the phone number associated with your channel, or by email if available. You may provide notices to Quell by emailing hello@textquell.com.
